In New York State, No-Fault Insurance is the system used to indemnify  people in car accidents when the amount of the accident is below $50,000.  It is called no-fault insurance, because it is available without regard to which party might have caused the accident.  Both parties are indemnified for losses by their own insurance company, regardless of who was at fault in the accident.  This system serves to restrict the right of either party to file a lawsuit from the other party in exchange for a streamlined system set up to minimize bureaucratic inefficiency and strain on the court justice system.

No-Fault Applications must also be filed where the injured party was a pedestrian or riding a bicycle.



In New York State, you are required to provide the no-fault carrier with written notice of your accident within 30 days to protect your legal rights and interests. There are very few exceptions to this 30 day requirement.  You or your attorney must submit an Application for No-Fault benefits in order to be able to make a claim for past and future lost wages, medical bills and other expenses.
